Terms of Service

These terms govern your use of the Zeph website, the Zeph web app, the Zeph companion app, and the Zeph devices, all provided by Zeph Click Ltd (company number 15274277), 20 Wenlock Road, London, United Kingdom, N1 7GU ("Zeph", "we", "us").

By creating an account or using our software or devices, you agree to these terms. If you do not agree, do not use them.

Accounts and beta access

You may need an account to use some features. You are responsible for keeping your credentials secure and for activity under your account. Some features are offered as a waitlist or beta and may change, be limited, or be withdrawn. You must give accurate information, must not misuse the service, and must not use it unlawfully. We may suspend or close an account that breaches these terms.

Licence to use the software

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Zeph companion app and firmware updates for their intended purpose. You may not sell, sub-licence, or reverse-engineer the software except to the extent the law allows you to. The companion app is free to download; we may offer paid plans for additional features.

Third-party services (bring your own key)

Zeph works with voice and AI providers that you connect using your own keys or accounts. Those providers are governed by their terms and privacy policies, and your use of them is between you and them. We are not responsible for third-party services, their availability, or how they handle your data.

Payments and refunds

Where you pay us — for example the £1 reservation deposit, or a future plan — payment is processed by Stripe; we do not store your card details. [TO CONFIRM: the £1 reservation is fully refundable and comes off your pledge; confirm refund mechanics and whether UK/EU distance-selling cancellation rights apply.] Prices may include taxes where required.

Warranties and "as is"

To the maximum extent permitted by applicable law, the software and services are provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by applicable law, Zeph will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the software or services. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these terms will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms limits or excludes any liability that cannot be limited or excluded under applicable law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any of your statutory rights as a consumer, which are not affected by these terms.

Intellectual property

Zeph and its licensors own the software, the Zeph name and marks, and the site content. These terms do not transfer any of those rights to you. You keep ownership of the content you create.

Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these terms or if we must to comply with the law. On termination your licence ends; your data is handled per the Privacy Policy.

Changes to these terms

We version these terms: any material change bumps the version and effective date shown at the top. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, without affecting any mandatory consumer-protection rights you have where you live.
